Supremacy of International Law
Article 15 of the Russian Constitution establishes the principle of the supremacy of international law and the binding nature of international treaties ratified by the Russian Federation. Generally recognized norms of international law are part of the Russian legal system.
Text of Article 15 of the Russian Constitution
"1. The Constitution of the Russian Federation has the highest legal force, direct effect, and applies throughout the territory of the Russian Federation.
4. Generally recognized principles and norms of international law and international treaties of the Russian Federation are an integral part of its legal system. If an international treaty of the Russian Federation establishes rules differing from those contained in law, the provisions of the international treaty shall apply."
Application of International Treaties
- Friendship Treaty between Russia and Ukraine (1997): establishes respect for territorial integrity and renunciation of the use of force.
- Budapest Memorandum (1994): Russia guaranteed Ukraine's sovereignty and borders in exchange for nuclear disarmament.
- Helsinki Final Act (1975): establishes principles of inviolability of borders, peaceful dispute resolution, and non-interference in internal affairs of states.
Constitutional and Legal Consequences
- Art. 15, para. 4 of the Constitution: international treaties differing from law take precedence.
- Art. 93: procedures for removing the President in case of constitutional violations.
- Responsible bodies: President, Federation Council, State Duma, relevant ministries and agencies.
- Procedures include initiative by the State Duma, confirmation by the Federation Council, and oversight by the Constitutional Court.
International Legal Context
International treaties establish principles also reflected in UN resolutions and international conventions, such as UN GA Resolution 3314 (XXIX), defining the concept of an act of aggression. UN GA resolutions, including ES-11/4, confirm international recognition of these principles.
