Illegal Armed Formations, Financing, and Mismanagement
The Russian state systematically supplied DPR/LPR armed formations with weapons, ammunition, training, and financial support, violating:
- Art. 208 CC RF — organization and participation in illegal armed formations;
- Arts. 201, 285, 285.1, 285.2, 286 CC RF — abuse, misuse, and excess of authority in financing and resource management;
- Art. 172 CC RF and Budget Code — embezzlement or misuse of state funds for armed formations and "humanitarian convoys".

Excess of Authority in Creation and Management of Armed Formations
Senior Russian officials — President, ministers, commanders, and intelligence leaders — exceeded their authority by authorizing, financing, and directly managing illegal armed formations (DPR/LPR, PMC Wagner) in Ukraine. These actions fall under Art. 286 CC RF as abuse of official powers resulting in serious consequences.
Text of Article 286 CC RF
“1. Actions of an official exceeding authority and causing substantial violation of citizens' or organizations' rights, or legally protected interests of society or the state — punishable by fine or imprisonment up to 4 years.
2. The same actions by officials of state authorities of the Russian Federation...
3. If such actions:
a) involve violence...
b) result in serious consequences, — imprisonment from 3 to 10 years with disqualification from certain positions...”
Documented Cases (2014–2025)
- 2014: Deployment of Russian units in Donbas without formal approval — violation of Art. 102 Constitution RF.
- 2014–2021: Ministry of Defense and GRU supplied heavy weapons without parliamentary approval (OSCE, Bellingcat).
- 2021–2022: Decrees №71, №72 recognizing parts of Donetsk and Luhansk regions as independent states — excess of authority under Arts. 80–81 Constitution RF.
- 2022–2025: Integration of armed formations into Russian Armed Forces; salaries from federal budget — management of foreign armed groups (SBU, OSINT).
- PMC Wagner: Financing via Concord, operations abroad without direct state control (Mediazona, OCCRP).
Consequences
- International sanctions and SWIFT disconnection (over $300 billion frozen assets);
- Losses among Russian military personnel ("volunteers");
- NATO strengthening at Russian borders;
- Demographic and economic crises in Russia;
- Precedent for domestic and external armed conflicts.
Qualification and Responsibility
- Part 3(b): Abuse with serious consequences — imprisonment from 3 to 10 years.
- Subjects: President, Minister of Defense, Chief of General Staff, commanders of Southern Military District, heads of FSB/SVR, coordinators of DPR/LPR regions.
- Evidence: decrees, satellite imagery, videos, interceptions, testimonies, OSCE reports, ECHR decisions.
International Context
These actions violate Art. 2(4) UN Charter, Helsinki Accords, and Budapest Memorandum. UN General Assembly resolutions (2022) and ECHR decisions (2023) confirm illegality. ICC warrants (2023) include charges related to illegal use of armed formations.
