Legal Qualification of Ukrainian Citizens’ Cooperation with Russia
Article 111 of the Criminal Code of Ukraine (CCU) establishes responsibility for Ukrainian citizens who act against Ukraine’s sovereignty, territorial integrity and inviolability, defense capability, as well as state, economic, or information security. Cooperation with the occupational forces of the Russian Federation, especially in leadership positions, intelligence, or defense sectors, qualifies as high treason.
Key Provisions of Article 111 (CCU)
- Forms: Defection to the enemy during martial law or armed conflict; espionage; providing a foreign state, foreign organization, or their representatives with assistance in subversive activities against Ukraine.
- Penalty: Imprisonment for twelve to fifteen years with or without confiscation of property.
Difference: Unlike Article 111-1 CCU (Collaboration Activities), High Treason requires more severe and deliberate cooperation, including direct harm to national security and usually involves military or intelligence activities, or defection to the enemy.
Evidence of Violation (Actions of Ukrainian Citizens)
Cooperation qualified as high treason includes the following actions committed by Ukrainian citizens in favor of Russia or its occupation administrations:
- Defection to the enemy: Participation in combat against the Armed Forces of Ukraine within illegal armed formations controlled by Russia. Example: Ukrainian citizens joining "DPR/LPR" armed formations from 2014–2022.
- Assistance in subversive activities: Providing occupation authorities with access to critical infrastructure, state registries, secret documents, or strategically important information. Example: sharing data on military installations, logistics, and defense plans.
- Holding leadership positions: Working in illegal occupation authorities, law enforcement, or courts under Russian control in temporarily occupied territories to undermine Ukraine’s constitutional order. Example: appointing Ukrainian citizens as "heads of administrations" in Crimea and Donbas.
- Espionage: Collecting and transferring state-secret information to the Russian side. Example: providing intelligence on troop positions, critical infrastructure, and defense plans.
Subject of the Crime
The subject under Article 111 is only a Ukrainian citizen aged 16 or older. Foreigners or stateless persons committing similar acts are prosecuted under other articles, such as espionage (Article 114 CCU) or mercenary activity (Article 447 CCU).
Legal Consequences
- Investigations under Article 111 CCU are conducted by the Security Service of Ukraine (SBU) and the State Bureau of Investigation (DBR), including cases of collaboration and high treason.
- Judicial sentences, including in absentia, are applied to citizens who directly facilitated Russian aggression.
- Basis for property confiscation and long-term imprisonment depending on the severity of actions and harm to national security.
