Legal Qualification of the Destruction of Railways, Bridges, and Roads
Article 277 of the Criminal Code of Ukraine (CCU) establishes criminal liability for intentional destruction or damage to railways, facilities, rolling stock, signaling and communication systems, bridges, roads, water supply structures, and other transport infrastructure if it caused or could have caused a traffic accident, disruption of normal transport operation, or threatened human life.
Key Provisions of Article 277 (CCU)
- Part 1 (Basic Offense): Intentional damage to transportation routes causing accidents or disruption of transport (Punishment: Fine, corrective labor, or restriction of freedom up to 3 years).
- Part 2 (Qualified Offense): Acts causing serious bodily injury or death (Punishment: Imprisonment from 5 to 10 years).
- Part 3 (Especially Qualified Offense): Acts causing the death of multiple people or especially serious consequences (Punishment: Imprisonment from 7 to 15 years).
Intentional Destruction of Infrastructure: Targeted missile strikes, air bombardments, and sabotage-reconnaissance group (SRG) operations by Russia aimed at destroying transport hubs, railway bridges, and key roads fall under Article 277 CCU, especially under qualified parts if they resulted in civilian casualties or blocked evacuation routes.
Connection with War Crimes and Sabotage
- Article 438 CCU (Violation of the Laws and Customs of War): If the destruction of civilian infrastructure was not dictated by military necessity and caused civilian deaths.
- Article 113 CCU (Sabotage): If the destruction was committed to weaken the state and disrupt logistics.
Evidence of Violation (Transport Terrorism)
- Attacks on railway stations: Shelling of railway stations and tracks causing civilian casualties (e.g., Kramatorsk, March 2022).
- Bridge destruction: Destruction of strategic road and railway bridges in Kharkiv and Dnipropetrovsk regions to disrupt logistics and isolate regions.
- Road mining: Placement of mines and explosive devices on roads, causing civilian vehicle explosions and hindering evacuation.
Legal Consequences
Qualification under Article 277 CCU allows holding accountable those whose actions directly threaten the lives of civilians using transport and cause significant damage to Ukraine's economic and defense infrastructure. The especially qualified offense (Part 3) provides for long prison terms and confiscation of property if the acts were committed with terrorist intent.
