Legal Qualification of Unauthorized Access, Modification, or Destruction of State Registry Data
Article 362 of the Criminal Code of Ukraine (CCU) establishes criminal liability for unauthorized actions with information processed in computers, automated systems, computer networks, or communication networks. Such actions include modification, destruction, copying, transfer, or blocking of information without authorization or beyond granted privileges. In conditions of occupation, this article applies to individuals who gain unauthorized access to Ukrainian state registries (real estate, land cadastre, demographic registries) with the intent to falsify, destroy, or transfer data to occupying administrations.
Key Provisions of Article 362 (CCU)
- Part 1 (Basic Offense): Unauthorized actions with information causing leakage, loss, falsification, blocking, or disruption of proper routing (Punishment: Fine, corrective work, or restriction of liberty up to 3 years).
- Part 2 (Qualified Offense): Repeated actions, or committed by prior conspiracy of a group, or causing significant damage (Punishment: Imprisonment up to 5 years).
- Part 3 (Severe Offense): Actions causing serious consequences (Punishment: Imprisonment from 3 to 8 years).
Manipulation of Registry Data: Unauthorized acquisition of information from state registries by occupiers and collaborators is critical for legitimizing illegal actions, such as "nationalization" of property or preparation of pseudo-elections. Destruction of registry data creates legal chaos and erases evidence of Ukrainian law in occupied territories. Examples include mass copying of cadastral registry data from 2014–2022 in temporarily occupied areas and attempts to alter property records in Crimea and Donbas from 2022–2025. Such acts are qualified under Parts 2 or 3 of Article 362 CCU.
Evidence of Violation (Property Falsification)
- Modification of ownership data: Unauthorized changes in real estate and land cadastre registries for illegal transfer of property to the occupation administration or affiliated individuals.
- Destruction of demographic data: Deletion of information on residents, including birth, death, and marriage records, to create a legal vacuum.
- Unauthorized copying and transfer: Transmission of full databases of Ukrainian citizens to Russian intelligence or illegal structures in occupied territories.
- Blocking access: Actions aimed at preventing remote access by Ukrainian authorities to registries on servers in occupied regions.

Legal Consequences
Application of the qualified parts of Article 362 CCU (up to 8 years imprisonment) allows strict punishment of individuals using information systems to commit serious crimes against the sovereignty and property rights of Ukrainian citizens. These cases have evidentiary value for investigating crimes of aggression and war crimes in international courts.
