Legal Qualification of the Use of Prohibited Means and Methods of Warfare
Article 439 of the Criminal Code of Ukraine (CCU) establishes liability for development, production, acquisition, storage, sale, transportation, or use of weapons of mass destruction, as well as for use of other means of warfare prohibited by international treaties. In the context of Russian aggression, the article applies to the use of cluster munitions and other indiscriminate weapons, especially targeting civilians and urban areas.
Key Provisions of Article 439 (CCU)
- Part 1 (Basic Composition): Development, production, acquisition, storage, sale, transportation, or use of weapons of mass destruction (Penalty: Imprisonment from 3 to 10 years).
- Part 2 (Aggravated Composition): Use of other means of warfare prohibited by international treaties (Penalty: Imprisonment from 5 to 12 years).
Use of cluster munitions: Deployment of cluster munitions in populated areas, such as Kharkiv, Mykolaiv, and Bucha, violates the principles of distinction and proportionality under international humanitarian law (IHL). Such actions are qualified under Part 2 of Article 439 CCU and simultaneously under Article 438 CCU (Violation of the Laws and Customs of War).
Evidence of Violation (Indiscriminate Weapons)
- Use of cluster munitions: Strikes on residential areas with rockets and shells containing multiple submunitions, causing indiscriminate harm to civilians.
- Use of phosphorus munitions: White phosphorus shells in populated areas causing severe burns and suffering (violation of Protocol III to the Convention on Certain Conventional Weapons).
- Strikes on civilian objects: Use of precision or prohibited weapons against non-military targets, such as residential buildings, schools, and hospitals.
Relation to Other Articles
- Article 438 CCU — Violation of the Laws and Customs of War (general qualifying basis).
- Article 442 CCU — Genocide, if the use of prohibited weapons is aimed at destroying a national group.
Legal Consequences
Application of Article 439 CCU allows for holding accountable both the perpetrators and the command issuing orders to use prohibited weapons. Evidence under this article is critical for international investigations and trials of war criminals.
