Legal Qualification of Collecting and Transmitting State Secret Information
Article 114 of the CCU establishes criminal liability for transmitting or collecting with the intent to transmit to a foreign state, foreign organization, or their representatives information constituting state secrets. Espionage is one of the gravest crimes against national security as it directly undermines Ukraine's defense capability, economy, and information security.
Key Provisions of Article 114 (CCU)
- Basic Offense: Transmitting or collecting information constituting state secrets to a foreign entity (Penalty: imprisonment from 10 to 15 years).
Offender: Can be a citizen of Ukraine, foreign national, or stateless person. The crime is considered complete from the moment of transmission or even from the moment of collection with intent to transmit. Example: foreign agents operating via legal companies or social networks collecting data on AFU equipment or command posts.
Evidence of Violation (Collection of Data on AFU and Infrastructure)
- Collection of AFU data: Photo and video recording of locations, movement routes, personnel strength, equipment, and defensive positions of the Armed Forces of Ukraine. Example: filming military bases and observing armored vehicle movements.
- Transmission of critical infrastructure data: Collecting information on protection, vulnerabilities, and locations of energy, communication, and transport facilities for planning strikes or sabotage. Example: leaking substation and bridge layouts used to adjust Russian missile strikes.
- Collection of government data: Obtaining classified information about plans and decisions of government authorities related to defense and security. Example: leaking plans for troop supply and evacuation.
- Use of agent networks: Organizing and financing networks for continuous intelligence gathering in favor of the aggressor state. Example: informer networks in border regions and occupied territories.
