Legal Qualification of Propaganda Justifying Armed Aggression
Article 436-2 of the Criminal Code of Ukraine (CCU) was introduced to combat ideological justification and support for armed aggression by the Russian Federation. It establishes criminal liability for publicly justifying, recognizing as lawful, or denying Russia’s armed aggression against Ukraine, as well as for glorifying persons who committed this aggression.

Application to propaganda: This article allows holding accountable those who spread narratives portraying Russian aggression as a "special military operation," "protection of Russian-speaking population," or "denazification." Real examples include publications on social networks and media justifying the Russian invasion or glorifying Russian military personnel involved in the aggression, including calls for "liberating" Ukrainian territories.
Evidence of Violation (Denial of Aggression)
- Public denial of sovereignty: Statements claiming Ukraine "should be part of Russia" or denying the fact of armed aggression.
- Justification of war crimes: Statements in media, social networks, or public events that justify actions of Russian troops or occupation authorities. For example, posts about "legitimate objectives of the special operation" and Russia’s "self-defense."
- Glorification of aggression participants: Display of symbols, commemorative signs, or speeches honoring Russian military personnel involved in the aggression.
- Use of symbolism: Z or V symbols, public wearing of clothing with Russian military insignia in occupied territories and Russia to promote aggression.
