Illegal Arms Handling and Border Violations
Transfer, transport, and storage of explosives and military equipment across state borders without proper permits constitute serious violations of Russian law:

Illegal Handling of Explosives and Devices in Conflict Zones
Individuals associated with state and non-state structures in Russia systematically acquired, stored, transported, and transferred explosives (TNT, RDX, Plastid), mines, grenades, and IEDs across borders without licenses. These actions fall under Part 4 of Article 222.1 CC RF — large-scale handling by an organized group.
Text of Article 222.1 CC RF
1. Illegal acquisition, transfer, sale, storage, transport, or carrying of explosives — imprisonment from 3 to 8 years.
2. Same acts committed by a group by prior agreement — imprisonment up to 10 years.
4. Acts committed by an organized group — imprisonment from 8 to 15 years.
Documented Cases (2014–2025)
- 2014–2022 (Donbass): OSCE documented numerous cases of cargo movements through uncontrolled border areas without determination of content;
- 2022 (Mariupol, Bakhmut): cases of PFM-1 mines and other munitions used in populated areas documented (HRW);
- 2022–2025: columns of EMERCOM and other state structures moved without transparent customs control (OSCE, OSINT), actual cargo content not established;
- PMCs: PMC “Wagner” had access to explosives and IED storage (video evidence and fighter testimonies);
- Systematic operations: warehouses and column movements indicate organized logistics (satellite imagery, OSINT, 2023–2025).
Qualifying Features
- Organized groups (state structures, PMCs);
- Large-scale (over 100 kg of explosives);
- Use of official position;
- Potential qualification under Art. 356 CC RF for use of prohibited means of warfare.
Legal Qualification and Responsibility
- Part 4: organized group — 8–15 years imprisonment;
- Subjects: artillery commanders, engineers, supply officers, PMC coordinators, individuals from DNR/LNR;
- Evidence: warehouse logs, videos, satellite images, explosives registries, materials from ICC international investigations in Ukraine.
International Legal Context
These actions may constitute war crimes under Art. 8(2)(b)(xx) of the Rome Statute (prohibited use of anti-personnel mines), and are referenced in UN GA resolutions on compliance with international humanitarian law and ECtHR rulings (2024) under Art. 2 ECHR.
